The 28-year-old woman, originally from Paraguay, hit her baby girl over the head after giving birth at a house in Malaga.
She then put the infant in a plastic bag which she placed outside under another bag, to ensure that her baby would suffocate.
The baby suffered a fracture to its skull, loss of blood through its umbilical cord and suffocation.
The woman had been living unofficially in Spain along with her other daughter, who is three.
Having been taken on by a Spanish family to help care for their relative who had Alzheimer’s, she and her daughter had been kept on after the relative died.
The woman had hidden her pregnancy from the family for fear of their reaction.
But when she suffered heavy bleeding from the birth, she was forced to go to hospital.
A doctor realised what had happened and called the police, who later discovered the dead baby outside her house.
The woman claimed she had not intended to kill the child.
She said she had dropped her twice after giving birth and that she had tried to resuscitate her.
Doctors however said the blow the child had suffered was of a ‘high intensity’.
Malaga’s provincial court ruled that she had hit her child ‘consciously and deliberately, with intent to kill her,’ and that she had placed the child in the plastic bag ‘with the clear intention of getting rid of it’.
The court ruled that this crime constitutes premeditated murder.
